  1. What is the Criteria for claiming against any Credit Agreement?
    The agreement must have been taken out before April 2007 and the remaining balance must be over £1000 and less than £25000. We can audit the agreement to establish that it is deemed as unenforceable by any breaches of the Consumer Credit Act 1974.
  2. What is the Criteria for claiming for any mis-sold insurance policy?
    The agreement and insurance must have been taken in the last 6 years and fit at least one or more of the mis-selling categories.
  3. Can I claim for a mis-sold PPI policy if I have already made an insurance claim with them?
    You cannot claim on the insurance, use the policy and then try and argue that is was mis-sold to you because you will not be entitled to the refunds as you have made beneficial use of the policy.
  4. I am in a debt management programme, how will this work?
    We can still process claims even if you are a debt management programme.
  5. What are the fees involved for mis-sold PPI or LPI?
    At abacus, with PPI/PLI claims we work on a NO Win NO Fee basis.
  6. What are the fees involved for Unfair Credit Agreements?
    An upfront fee is needed before we can start any work. This all depends on the number of claims you wish to put forward and the value of the claim.
  7. What if after agreeing for Abacus to take on my claim, there is nothing that can be done. What happens to the upfront fee paid?
    You will get a full refund with no hidden charges.
  8. What if I can afford the upfront payment?
    We offer a four monthly installment procedure, where the payment can be split within the first four months.
  9. What documents do I need to keep ready when being in touch with you?
    • The credit card or loan agreement number
    • Date of the agreement
    • Outstanding balance of loan/ credit card etc
  10. What can I claim on?
    You can claim on credit cards, store cards, car finance, consolidation loans, unsecured loans, hire purchase.
  11. Can I still use my card?
    We advise you to stop using your card and maintain your payments when the process begins.
  12. What if the case goes to court?
    In this unlikely event of your case going to court, your costs are covered.
  13. Is there an alternative to using Abacus Reclaims?
    Yes, you could try and deal with the creditors yourself or use alternative schemes. However it is unlikely your creditor will settle without the threat of legal action, which can be very costly. You could also seek assistance from organisations such as the Citizens Advice Bureau or the Financial Ombudsman Services.
