Terms and Conditions

    What Abacus Reclaims will do for you:

  1. We will examine the validity of your Payment Protection Insurance and (PPI), if appropriate, pursue on your behalf, a claim for the reimbursement of payments made of PPI, plus statutory interest and future repayments discontinued.
  2. We will correspond and negotiate with the defendant on your behalf in this action.  We will require you to sign a ‘Letter of Authority’ to facilitate this.
  3. We will inform you of all offers that we receive from the defendant: evaluate them and advise you in writing whether we consider it to be in your interest to accept or reject the offer.
  4. We will forward to you any monies agreed in settlement of your claim with the defendant, subject to the conditions in parts 3.
  5. We will endeavour at all times to provide you with the professional and dedicated service.  We will use all reasonable skill and care in the processing of your claim.
  6. We will endeavour to provide resolution to any claim with us but where this is not possible due to any change of influence or the business practices of Abacus Reclaims either internal or external we will seek to resolve your claim as soon as circumstances permit.
  7. We will return all your documents (including bank statements, policy or credit agreements) upon receipt of all monies due in accordance with this agreement.
  8. What Abacus Reclaims will not do for you:

  9. We will not advise you to accept an offer that we consider inadequate or to reject an offer that we consider to be reasonable, and we reserve the right to cancel this Agreement if you wish to accept an offer that we consider inadequate or to reject an offer that we consider to be reasonable.
  10. We will not accept an offer without your agreement.
  11. We will not give or offer you financial advice.
  12. What we expect from you:

  13. To provide us promptly with all relevant information and items we request to enable us to pursue your claim.
  14. To provide us with clear instructions.
  15. To cooperate with us (including sending to us any correspondence you receive directly from the defendant)
  16. Not to ask us to work in an improper or unreasonable way or to mislead us.
  17. To provide us with the exclusive authority:
  18. To pursue your claim;
  19. To enter on your behalf into correspondence and negotiations;
  20. To read all of our terms and conditions for your own reference.
  21. To retain a copy of our terms and conditions for your own reference.
  22. Fees

  23. Depending on which service you take with the company we may charge you and upfront Fee or it will be on a no win no fee basis,
    On completion/success you agree to pay us the fee of 25% of any compensation payment or award including all and any redress and amended contracts.

    (Example (1) commission, claim awarded of £5000.00 x 25% equals commission payable to Abacus Reclaims is £1250.00)

    (Example (2) commission, claim awarded of £1000.00 x 25% equals commission payable to Abacus Reclaims is £250.00).

    This commission is based on our success with your claim if your bank, building society, product supplier or lender agree to make a compensation payment direct to you or make payments directly off your existing accounts. You agree commission payment to Abacus Reclaims will be paid within 7 days of completion.

  24. Cancellation

  25. Abacus Reclaims can cancel this agreement and no fee will be payable by you if we think there are no grounds for a complaint or your case is most likely to not succeed.
  26. The Company shall have the right to terminate the contract if there is a material breach by the client, the client has been declared bankrupt or the client does not follow any recommendations of the company.
  27. The termination shall be in writing within 15 days of specifying any of the above three points.
  28. The client has a right to cancel by giving written notice to the company within 14 days of signing the contract.
  29. In the event that the client terminates the contract after 14 days the company has a right to charge a cancellation fee that would reflect the work undertaken by us in pursuit of your claim. This could be anything up to the full fee. If we have received an acceptance of liability or compensation from the lender, a charge of three hundred and fifty pound or 25% of the claim, whichever is greater in value.
  30. Refunds Policy

  31. If you take up a service with Abacus Reclaims that requires an upfront fee, we provide a 14 day cooling off period and if for any reason you change your mind, there would be no charge for cancellation. If however, after the 14 day cooling off period you find you are not happy with the service we promised to offer you, you would be entitled to a full refund of all monies made to Abacus till date.
